BOOKING TERMS & CONDITIONS

IMPORTANT SAFETY AND LEGAL NOTICE

Outdoor hiking and mountain travel involve risks of serious injury and death. Every participant must review and sign the separate Release of Liability, Waiver of Claims and Assumption of Risks Agreement. The waiver is a separate, important contract and is not hidden in these general terms.

1. About these Terms

These Booking Terms & Conditions (the “Terms”) apply to tours and related services sold directly by Sea to Peak Guided Tours, operating as Sea to Peak Tours (“Sea to Peak”, “we”, “us” or “our”). By completing a booking, the purchaser agrees to these Terms. Each participant must also separately agree to the participant requirements and sign the applicable risk and liability document before taking part.

• A booking is accepted only when full payment is successfully processed and Sea to Peak issues a booking confirmation.

• The booking confirmation, selected tour description, price shown at checkout, these Terms and the separate participant waiver form the agreement for the booking.

• A person booking for others must provide accurate participant information and ensure each participant receives these Terms. A purchaser cannot sign a liability waiver on behalf of another adult.

• Bookings made through a third-party marketplace are also subject to that platform’s payment and cancellation terms. Sea to Peak’s safety requirements and participant waiver still apply. If there is a conflict about the platform transaction, the platform’s terms govern that transaction, subject to applicable law.

2. Services, Tour Details and Currency

Sea to Peak provides small-group guided hiking experiences originating in Vancouver. Unless the selected tour page or confirmation states otherwise, the service includes the guided hike, round-trip transportation from the confirmed pickup point, a First Aid-certified guide, and complimentary water and snacks. The specific route, date, departure/start time, expected completion time, pickup arrangement, inclusions, exclusions and total price are shown in the tour description and booking confirmation.

• All direct prices and payments are in Canadian dollars (CAD), unless another currency is expressly shown at checkout.

• Departure, hiking and return times are estimates. Mountain, road, group and emergency conditions can cause delay.

• Photographs, distances, elevations, durations and route descriptions are reasonable estimates and illustrations, not guarantees of exact conditions or views.

3. Eligibility, Fitness and Health

Participants must select an experience appropriate for their fitness, health, experience and equipment. Hiking may involve prolonged exertion, elevation gain, uneven or exposed terrain and remote areas. Participants should obtain medical advice if uncertain about their ability to participate.

• Adults: the adult liability waiver is for participants aged 19 or older on the date of the tour.

• Under 19: advance written approval is required. A parent or legal guardian must complete the under-19 consent form and normally accompany the participant. Sea to Peak may impose route-specific minimum ages. A parent’s form does not purport to waive the minor’s independent legal rights.

• Participants must truthfully disclose information reasonably relevant to safe participation, including significant medical conditions, allergies, mobility limitations and required medications, using the confidential health and emergency form.

• Pregnancy, illness, injury, disability or a medical condition does not automatically prevent participation. Sea to Peak will discuss reasonable safety needs, but remote terrain and the essential physical requirements of a particular route may limit what can safely be offered.

• Sea to Peak may refuse or stop participation where, acting reasonably, a participant lacks required fitness or equipment, appears impaired, presents a material safety risk, or provided materially incomplete information. Refunds in that situation are governed by sections 7 and 11.

4. Participant Equipment and Preparation

Each participant is responsible for arriving with the clothing, footwear, food, water capacity, medication and personal equipment stated in the tour description or pre-trip message. At minimum, participants must bring secure running, trail or hiking shoes and weather-appropriate layers. Mesh, open-toed or badly worn footwear may be rejected where unsafe for the selected route.

• Participants must carry enough food for the tour. Complimentary snacks are supplemental and may not be suitable for allergies or dietary restrictions.

• Alcohol, illegal drugs, cannabis use during the tour, and participation while impaired are prohibited. Smoking or vaping may be restricted by park rules and wildfire conditions.

• Weapons and hazardous items are not permitted, except lawful safety equipment expressly approved in advance.

5. Pickup and Transportation

Pickup is from the location and at the time stated in the confirmation or final pre-trip message. Transportation may be provided or arranged through an independent licensed rideshare, taxi, charter or other transportation provider. Participants must obey the driver’s rules and wear a seatbelt where provided.

• Arrive at least 10 minutes before the confirmed pickup time. Sea to Peak is not required to delay the group for a late participant.

• A missed pickup, inability to locate the meeting point, invalid travel documents, or failure to be ready is treated as a no-show.

• Return location or vehicle may change where reasonably required by traffic, road closures, vehicle availability or safety.

6. Prices, Payment and Promotions

Full payment is due at booking. The itemized tour price, applicable taxes and fees, discounts, and total price are displayed before acceptance and repeated in the booking confirmation. Sea to Peak does not extend credit unless expressly agreed in writing.

• Promo codes must be entered or disclosed before payment and cannot normally be applied retroactively.

• A pricing or availability error may be corrected before a booking is confirmed. If a confirmed booking contains a material supplier error, Sea to Peak will offer the correct price for acceptance or a full refund.

• Chargebacks should not replace contacting Sea to Peak about a genuine concern. This does not limit any lawful credit-card remedy.

7. Guest Cancellations, Transfers and No-Shows

For direct bookings, cancellation notice must be sent to the email address above. It is effective when sent. The following commercial policy applies unless the selected tour, a written group/private-tour agreement, a marketplace policy, or non-waivable law provides a more favourable right:

Conditions: There is no automatic refund or credit. Sea to Peak may depart at the confirmed time and is not responsible for alternate transport.


• One participant substitution may be requested before departure if the substitute meets all requirements and completes the applicable forms. Price differences may apply; marketplace bookings may not be transferable.

• If a participant voluntarily leaves after the tour begins, no refund is due and the participant is responsible for safe return transportation and related costs.

• Nothing in this section removes a cancellation or refund right that cannot lawfully be waived, including rights that may arise from incomplete or late delivery of an online sales contract.

8. Sea to Peak Cancellations and Material Changes

Safety comes first. Sea to Peak may cancel, delay, shorten, reroute or substitute an experience because of weather, trail, snow, smoke, wildfire, wildlife, road, vehicle, permit, park closure, guide illness, group capability, emergency or other circumstances affecting safety or feasibility.

• If Sea to Peak cancels before departure, including because weather or related trail conditions prevent the tour from operating safely, Sea to Peak may offer a free replacement date or comparable available alternative. If the purchaser or participant cannot attend the replacement date or accept the alternative, a full refund will be provided to the original payment method. If an accepted alternative costs less, the difference will be refunded.

• If Sea to Peak materially changes the advertised destination before departure, the purchaser may accept the change or receive a full refund.

• After departure, the guide may change the route, pace, turnaround point or activity for safety. If a reasonable guided alternative is delivered, no refund is automatically due; Sea to Peak will assess any material shortfall fairly.

• Sea to Peak is not responsible for a participant’s separate airfare, accommodation, meals, lost work or other consequential travel costs, to the extent permitted by law. Travel insurance is strongly recommended.

9. Conditions, Permits and Parks

Tours take place in public parks, wilderness and mountain areas that Sea to Peak does not control. Access can depend on road conditions, day-use passes, permits, quotas and closure decisions by government or land managers. A specific view, summit, lake, wildlife sighting or trail condition is not guaranteed.

10. Guide Authority and Group Safety

Participants must promptly follow reasonable guide instructions, stay with the group, respect turnaround times, disclose developing symptoms, and comply with laws and park rules. The guide may set the pace and has final operational authority over route, turnaround and safety decisions.

11. Conduct and Removal

Sea to Peak may remove or refuse a participant who is violent, threatening, harassing, discriminatory, reckless, impaired, repeatedly disobedient, destructive, or materially endangers the group. Where removal results from the participant’s conduct or breach, no refund is due and the participant is responsible for reasonable alternate transport and damage costs. This clause will be applied reasonably and consistently with applicable human-rights law.

12. Risk Acknowledgment and Separate Liability Waiver

Hiking, mountain travel and associated transportation involve inherent and other risks, including slips, falls, exposure, changing weather, wildfire, wildlife, water, snow or ice, rockfall, traffic incidents, remote rescue, equipment failure, the conduct of other people, and negligence. The separate participant waiver contains the complete risk assumption and release language. It must be presented prominently and accepted separately. Refusing the waiver means the person cannot participate and the cancellation policy applies if the waiver requirement was disclosed before booking.

13. Medical Care, Emergency Response and Insurance

A guide may provide first aid within their training, contact emergency services, share relevant health information with responders, and arrange evacuation where reasonably believed necessary. Wilderness response may be delayed or unavailable. The participant is responsible for ambulance, evacuation, hospital and other third-party medical costs not covered by insurance.

• Participants should carry health coverage valid in British Columbia and travel insurance covering hiking, cancellation, interruption and emergency evacuation.

• Sea to Peak is not a medical provider and does not guarantee the outcome or availability of first aid, rescue or treatment.

14. Food, Allergies and Personal Property

Snacks and water may be handled in environments where allergens are present. Sea to Peak does not guarantee an allergen-free product or environment. Participants with allergies must disclose them, carry prescribed medication, and bring safe food. Participants are responsible for their phones, passports, equipment and other property. Sea to Peak is not liable for ordinary loss, theft or damage except to the extent caused by liability that cannot lawfully be excluded.

15. Personal Information and Images

Sea to Peak collects and uses booking, contact, health and emergency information only for reasonable business, safety, legal and insurance purposes, and may disclose necessary information to guides, transportation providers, emergency responders, insurers, payment processors, booking platforms and authorities. Sensitive health information is access-restricted and retained only as long as reasonably necessary or required by law.

• Marketing use of an identifiable participant’s image requires separate, optional consent. Declining image consent does not affect the booking.

• Questions or privacy complaints may be sent to the email address above for the attention of the Privacy Contact.

16. Complaints and Corrections

Contact Sea to Peak promptly if a booking confirmation is inaccurate or if a concern arises. We will review complaints in good faith and aim to propose a fair response. A consumer may give any statutory cancellation notice by a method that creates evidence of the date sent, including email to the address above.

17. Limits, Consumer Rights and Indemnity

The separate participant waiver governs personal injury, death and property claims arising from participation. To the maximum extent permitted by law, Sea to Peak is not liable for indirect or consequential loss, loss caused by information the participant withheld, or the acts of independent third parties outside Sea to Peak’s reasonable control. A participant is responsible for loss caused by their wilful misconduct, negligence, unlawful conduct or material breach of these Terms.

NON-WAIVABLE RIGHTS

Nothing in these Terms or any waiver limits rights, remedies, duties or protections that cannot lawfully be waived or released under the Business Practices and Consumer Protection Act or other applicable law.

18. General Legal Terms

• Governing law: British Columbia law and applicable federal law govern, subject to any mandatory consumer law of another jurisdiction.

• Forum: the parties submit to the courts of British Columbia, but this does not override a non-waivable consumer right to bring a claim elsewhere.

• Severability: if a provision is invalid or unenforceable, it is severed or limited to the minimum extent necessary; the remaining provisions continue.

• No waiver: a failure to enforce a provision once is not a waiver of future enforcement.

• Assignment: a participant may not assign the agreement except for an approved substitution. Sea to Peak may use qualified contractors but remains responsible as required by law.

• Electronic records: acceptance, signatures and notices may be electronic. The participant should retain the confirmation, these Terms and signed waiver.

• Entire agreement and priority: the documents listed in section 1 form the agreement. A written term specific to the confirmed booking prevails over these general Terms to the extent of a direct conflict; non-waivable law always prevails.

• Updates: the version accepted at booking governs that booking. Material changes will not be imposed retroactively without consent.
